The General Terms and Conditions apply to the delivery of goods, which are ordered by the customer (contracting partners) and are delivered by the supplier.
Deviations from our General Terms and Conditions, including those due to divergent General Terms and Conditions of the customer, require our written confirmation.
The customer declares him-/her-self as accepting our business conditions with his/her order.

Offers
Our offers are always without engagement. Verbal information and promises are only valid if they are confirmed in a written form. We do not asume any liability for availability of goods or changes in pricing. Furthermore, we reserve the right to deviate from illustrations, technical data and descriptions, indications of weight and to make mistakes or errors.

Orders
When we receive an order we assume that the customer has taken note of and accepted the validity of our listed business conditions.

Delivery
Goods are delivered to the address supplied by the customer.
In case of cash on delivery shipping, the delivery and invoice address must be identical.
The delivery is commonly carried out at the earliest possible date. Unforeseen delivery obstacles, such as force majeure, malfunctions in our operating procedure or in operating procedures of pre-suppliers or pre-manufacturers, strikes, transportation difficulties or any other unanticipated problems, disengage us from the obligation of delivery. Claims for compensation by the customer are excluded in cases of belated delivery or failure to fulfil obligations, provided that this is not based on firm intention or gross negligence.
In case of prepayed deliveries the paid amount of money is refunded to the customer if delivery proves impossible.
We reserve the right to carry out partial deliveries, provided that this is advantageous in terms of speeding up the delivery. In case of partial delivery only the dispatched products are charged for and subject to our usual business conditions.

Dispatch
The dispatch of goods is carried out by DHL, the Deutsche Post AG and other parcel services and forwarding agents, depending on the size and extent of the shipment and provided that there is no other agreement with the customer. Shipments that arrive damaged must be immediately queried in writing with the responsible carrier. A complaint to motogadget is only permitted after the carrier has established that the fault lies with us. Postage and transportation costs are charged according to the respective rates of the delivery services.
Dispatch is carried out by cash on delivery or cash in advance. Packing and transportation costs are charged to the customer. Express shipments are carried out only if specifically requested by the customer and attracts an extra charge. Dispatch is carried at the customer’s expense and risk. Responsibility passes to the customer with dispatch of the product. "DHL Parcels" are insured for transportation up to 500 €. Additional insurance will be arranged by us only at the express request of and will attract additional costs for the customer. Damages in transit must be reported immediately to the respective carrier and resulting costs must be settled with this carrier. Recognizable or visible transportation damage to the dispatched goods must be reported immediately to the carrier personnel and to motogadget. Information regarding damage caused in transit must include copy of the freight papers, on which the damage to packaging must be confirmed. Otherwise all insurance specifications are rendered invalid.

Prices
The charged prices are those valid on the day of delivery. All listed prices are in Euro (€) and do not include packing and transportation costs. All prices are subject to alteration and are ex Berlin. All published prices are final consumer prices. Listed prices are shown with the legal value added tax (from 01.01.2007 19% VAT) and without VAT. The latter is intended for customers outside of the European Union, who have not to pay European VAT but have to pay customs charges and turnover tax on imports according to the laws of the country concerned.

Payment
Payment is carried out by cash on delivery or prepayment, in so far, as no other agreements have been made with the customer. Deliveries to new customers are made exclusively against prepayment.
In the case of foreign customers, prepayment is generally required.
In the case of custom-made products or orders of an extraordinarily large number of items, a down payment on the total sum must be negotiated with us.
All products remain our property until the complete payment has been transferred.


Revocation and the right of return
According to distance selling law the customer is entitled to a right of revocation if the product has not reached the customer within 4 months of the ordering date. The revocation must be communicated via a durable data carrier or by return of the product and does not require any grounds. Compliance with the revocation period is accepted when written notice of revocation is punctually dispatched. Without revocation the customer is bound to his order for 4 months.
Customers are no longer bound to their order if they withdraw within a period of 2 weeks after receipt of the dispatched product. Revocation can be carried out without an explanation by sending an informal notice in writing or on another durable data carrier or by returning the product. Compliance with the revocation period is accepted when written notice of revocation is punctually dispatched or the product is punctually returned to the following address:

The right of revocation or return is only applied to items, which do not show any damages or traces of use.

Special models and parts, which are used in racing or under racing conditions are excluded from the right of revocation or return.
Pack the products carefully before they returning them. All returned items must neither be used nor damaged in any way and must be sent back in the original packing with the original invoice. We reserve the right to bill the customer for costs of repair to sent items or to refuse to accept returned products if they are damaged as a result of insufficient packing that diviates from the original packing.
Customers bear the costs for returning goods if the value of the goods does not exceed 40 €, except in cases where other agreements have been reached with motogadget. Customers also bear the costs of returning goods in cases where they have not yet made a payment or partial payment at the time of the revocation. Otherwise the contractor assumes these costs.
Refunding of freight costs only will be made up to the amount that corresponds to the postage charge for a normal dispatch.
Freight-collect returns are not accepted.

Gewährleistung
Wir gewährleisten 24 Monate ab Lieferdatum, das die Liefergegenstände bei Übergabe frei von Mängeln sind. Haftung für normale Abnutzung ist ausgeschlossen. Bei gebrauchter Ware beträgt die Gewährleistung 12 Monate ab Lieferdatum. Für Geschäfte mit Vollkaufleuten und Gewerbetreibenden ist die Gewährleistung mit Ablauf von 3 Monaten ab Lieferdatum ausgeschlossen. Anderweitige, als die vorgesehene Verwendung, Öffnen von Gehäusen sowie Manipulationen und Veränderungen, die Auswirkungen auf Funktion, Dichtigkeit und Sicherheit der Artikel haben, führen zum Erlöschen der Gewährleistung.
Für die von uns verkaufte Ware sowie von uns durchgeführten Arbeiten leisten wir bei berechtigten Mängelrügen nach unserer Wahl Gewähr durch Nachbesserung oder Lieferung eines gleichartigen und gleichwertigen Ersatzstückes unter Berücksichtigung des Abnutzungsgrades. Solange wir den Verpflichtungen zur Nachbesserung oder Ersatzlieferung innerhalb einer angemessenen Frist nachkommen, hat der Besteller nicht das Recht, Herabsetzung der Vergütung oder Wandlung des Vertrages zu verlangen. Schlägt die Nachbesserung fehl, leben die gesetzlichen Gewährleistungsrechte des Bestellers wieder auf.
Bei Geschäften mit Kaufleuten müssen offensichtliche Mängel innerhalb von 8 Werktagen, bei Geschäften mit Nichtkaufleuten spätestens 10 Werktagen nach Lieferung (Eingang beim Kunden) gerügt werden. Nicht offensichtliche Mängel spätestens 6 Monate nach Lieferung. Bei Nichteinhaltung dieser Fristen sind sämtliche Gewährleistungsansprüche ausgeschlossen. Die im Onlineshop abgebildeten Teile sind bezüglich der Maße, Zusammensetzung und der Beschaffenheit unverbindlich. Die Gewährleistung erlischt wenn Eingriffe/Reparaturen an gelieferter Ware durchgeführt werden welche nicht durch den Anbieter autorisiert wurden.

Sonderanfertigungen
Ein Rücktritt vom Kaufvertrag durch den Käufer ist bei Sonderanfertigungen nur möglich, falls das gewünschte Produkt nicht den vorher vereinbarten Kundenvorgaben entsprechen oder erhebliche Mängel aufweisen sollte. Mängelrügen hat der Käufer innerhalb von 8 Tagen zu erheben. Für die Fristsetzung ist der Eingang der Ware am Bestimmungsort und der Tag des Eingangs der Rüge maßgebend. Mängel, die auch bei sorgfältiger Prüfung innerhalb dieser Frist nicht entdeckt werden können, sind nach Entdeckung schriftlich zu rügen, der Originalkaufbeleg muß beigefügt sein. Normaler Verschleiß berechtigt nicht zu einer Mängelrüge. Spätestens 2 Jahre nach Gefahrübergang sind alle Mängelrügen ausgeschlossen. Mängelrügen berechtigen nicht zur Zurückhaltung von Zahlungen. Von uns als mangelhaft anerkannte Ware nehmen wir zurück oder ersetzen sie durch einwandfreie. Wir sind nach unserer Wahl berechtigt, anstelle des Ersatzes den Minderwert zu ersetzen. Alle weitergehenden mittelbaren oder unmittelbaren Schäden werden nicht ersetzt.
Die Teile, für die wir unentgeltlich Ersatz liefern, werden unser Eigentum. Sie sind vor jeder Veränderung zu schützen und uns auf Anforderung, auf Kosten des Käufers zurückzusenden. Der Anspruch aus Mängelrügen verjährt spätestens 1 Monat nach schriftlicher Zurückweisung der Mängelrüge durch uns. Die vorstehenden Rechte stehen dem Kunden nicht zu, wenn er seine Zahlungsverpflichtung nicht erfüllt.
Rücksendungen werden nur frachtfrei und in einem einwandfreien Zustand angenommen.

Sorgfaltspflicht
Der Kunde hat Sorge zu tragen, dass alle Änderungen und Umrüstungen an den im öffentlichen Straßenverkehr teilnehmenden Fahrzeugen den gesetzlichen Bestimmungen entsprechen und in die Fahrzeugpapiere eingetragen werden. Sämtliche Ansprüche des Kunden oder Dritter gegen den Anbieter, aus Unfällen oder Schäden jeglicher Art sind ausgeschlossen.

Datenschutz
Persönliche Daten des Kunden, die für die Bestellabwicklung notwendig sind, werden auf Datenträgern gespeichert. Der Kunde erklärt hiermit sein Einverständnis. Der Anbieter verpflichtet sich, alle personenbezogenen Daten vertraulich zu behandeln und nicht an Dritte weiterzuleiten, sofern dies nicht für die Bestellabwicklung notwendig ist.

Sonstiges
Wir behalten uns jederzeit vor, Preise, Aussehen, Design, Lieferumfang oder technische Ausführungen unangekündigt zu ändern. Aus den Inhalten dieses Internetangebotes können keine Garantien auf Preise, technische Ausführung, Design, Verfügbarkeit, Lieferzeiten usw. abgeleitet werden.

Sollten eine oder mehrere Bedingungen dieser Allgemeinen Lieferungs- und Zahlungsbedingungen aus irgendeinem Grund ganz oder teilweise unwirksam sein, so wird hierdurch die Wirksamkeit der übrigen Bedingungen nicht berührt.
